    As a note, the defence power in the constitution is:

    (vi.) The naval and military defence of the Commonwealth and of the several States, and the control of the forces to execute and maintain the laws of the Commonwealth.

    So 'defence' power is probably misleading as it appears to include the 'forces to execute and maintain laws' which would include non-martial assets?

      Should also note, that is not what Gleeson is arguing; "he power to make laws with respect to the naval and military defence ... is not limited to defence against aggression from a foreign nation; it is not limited to external threats ..."
